1. About These Terms
These Terms of Service govern your access to and use of the Perfume House website, including any purchase you make through the website.
In these Terms:
- “Perfume House”, “we”, “us” and “our” refer to Perfume house limited, trading as Perfume House.
- “Website” refers to https://perfumehouse.co.nz/.
- “You” and “your” refer to any person accessing the Website or purchasing from us.
- “Products” means the fragrances and other goods offered through the Website.
Perfume House is a New Zealand business selling goods in trade.
By accessing the Website, creating an account or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.
These Terms should be read together with our Refund, Return and Cancellation Policy, Privacy Policy and Shipping Policy.
2. New Zealand Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the:
- Consumer Guarantees Act 1993;
- Fair Trading Act 1986;
- Contract and Commercial Law Act 2017; or
- Any other New Zealand law that cannot legally be excluded.
Products sold for personal or household use must meet the guarantees required by the Consumer Guarantees Act, including being of acceptable quality, fit for purpose and consistent with their description.
If there is any conflict between these Terms and a mandatory requirement of New Zealand law, the law will apply.
3. Eligibility to Purchase
By placing an order, you confirm that:
- You are legally capable of entering into a binding contract.
- You are at least 18 years old or have permission from a parent or legal guardian.
- The information you provide is complete and accurate.
- You are authorised to use the selected payment method.
- You are purchasing for lawful purposes.
We may refuse or cancel an order where we reasonably believe it is fraudulent, unauthorised, unlawful or in breach of these Terms.
4. Website Information
We make reasonable efforts to keep product descriptions, photographs, prices and availability accurate and current.
However:
- Colours may appear differently depending on your screen or device.
- Product packaging, bottles, labels and presentation may be updated by a manufacturer.
- Manufacturers may change a product’s formulation or packaging without notice.
- Images may include props or decorative items that are not included with the product.
- Minor packaging differences do not necessarily indicate that a product is faulty or inauthentic.
Nothing in this section allows us to provide false or misleading information or limits your rights where a product is materially different from its description.
5. Fragrance Performance and Personal Preference
Fragrance is subjective. Its scent, projection, development and longevity may vary depending on factors such as:
- Skin chemistry;
- Application method;
- Weather and temperature;
- Storage conditions;
- Individual perception;
- Batch or formulation variations; and
- Olfactory fatigue or reduced sensitivity to a scent.
Personal dissatisfaction with a fragrance’s smell or performance does not necessarily mean the product is faulty.
If a product does not meet a guarantee under the Consumer Guarantees Act, your statutory rights will continue to apply.
6. Health, Allergies and Safe Use
Fragrances and cosmetic products may contain alcohol, essential oils, aroma compounds or other ingredients that can cause irritation or allergic reactions in some people.
You should:
- Read the manufacturer’s instructions and ingredient information where available.
- Conduct an appropriate patch test before regular use.
- Stop using a product if irritation or an adverse reaction occurs.
- Avoid contact with the eyes and damaged or irritated skin.
- Keep fragrances away from heat, flames and ignition sources.
- Keep products out of reach of children and pets.
- Seek medical advice if you have concerns about allergies, sensitivities or reactions.
Information on the Website is general product information and is not medical advice.
Nothing in this section limits liability that cannot legally be excluded.
7. Orders and Contract Formation
Adding a product to your cart does not reserve it.
When you submit an order, you are making an offer to purchase the selected products subject to these Terms. An automated order confirmation acknowledges that we have received your order but does not necessarily mean it has been accepted.
Your order is accepted when we:
- Confirm that it has been accepted;
- Begin preparing it for dispatch; or
- Dispatch the order,
whichever occurs first.
We reserve the right to decline or cancel an order before acceptance for a legitimate reason, including:
- The product is unavailable.
- Payment cannot be authorised.
- Delivery is unavailable to the address provided.
- Purchase limits have been exceeded.
- The order appears fraudulent or unlawful.
- There is a genuine and obvious pricing, promotional or product-information error.
If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.
We will not cancel an accepted order merely because we later decide that the agreed price was unfavourable to us. Your rights under the Fair Trading Act and other applicable laws remain unaffected.
8. Product Availability and Purchase Limits
All products are subject to availability.
Stock levels shown on the Website may occasionally be incorrect because of simultaneous purchases, inventory errors, damage or other circumstances.
We may apply reasonable purchase limits to scarce, promotional or high-demand products. We may also cancel quantities that reasonably appear to be purchased for unauthorised resale.
If we cannot supply an item, we will contact you and offer an appropriate alternative, partial refund or full refund for the unavailable item. We will not substitute a product without your agreement.
9. Prices and GST
Unless otherwise stated, all prices are displayed in New Zealand dollars.
Prices will include GST where Perfume House is required to charge GST. Delivery charges and any other applicable fees will be displayed or clearly explained before you complete your purchase.
We may change prices at any time, but a price change will not normally affect an order that has already been accepted.
10. Pricing and Website Errors
We take reasonable care to provide accurate prices and information.
If a genuine and obvious error is identified before an order is accepted, we may:
- Contact you and offer the product at the correct price; or
- Cancel the affected item and provide a full refund.
You will not be required to proceed at the corrected price.
Any pricing-error decision will be made reasonably and in accordance with the Fair Trading Act. Nothing in this section permits misleading pricing or advertising.
11. Promotions and Discount Codes
Promotions and discount codes may be subject to additional conditions shown with the offer.
Unless otherwise stated:
- Discount codes cannot be exchanged for cash.
- Only one discount code may be used per order.
- Discount codes cannot be applied after an order has been completed.
- Promotions cannot be combined with another offer.
- Excluded products, minimum spending requirements and expiry dates may apply.
- A promotion is available only while stock lasts.
- Delivery charges do not count towards a minimum purchase amount unless stated otherwise.
We may withdraw or correct a promotion before an order is accepted if it contains a genuine error or is being used fraudulently or contrary to its published conditions.
Statutory consumer rights continue to apply to discounted, promotional and sale products.
12. Payments
Available payment methods will be displayed at checkout.
You agree to provide accurate billing and payment information and authorise the applicable payment provider to charge the total shown at checkout.
Payments may be processed by third-party providers such as card processors, PayPal or Buy Now Pay Later providers. Your use of those services may also be subject to the provider’s own terms and privacy policy.
We do not control payment-provider processing times, account approvals, declined transactions or service interruptions.
If a payment is reversed, disputed or charged back without a valid basis, we may seek payment of any amount lawfully owed and suspend further orders. This does not prevent you from making a legitimate chargeback or exercising your legal rights.
13. Buy Now Pay Later
If you select a Buy Now Pay Later service, your agreement with that provider is separate from your purchase contract with Perfume House.
You remain responsible for complying with the provider’s payment schedule, fees and terms. Refunds made through a Buy Now Pay Later service will be processed according to the provider’s procedures.
14. Order Changes and Cancellations
Please contact us promptly if you need to change or cancel an order.
We will make reasonable efforts to assist if the order has not been packed or dispatched. We cannot guarantee that a change or cancellation will be possible after processing has begun.
Once an order has been dispatched, it cannot be cancelled before delivery. Any subsequent return will be handled under our Refund, Return and Cancellation Policy and New Zealand consumer law.
15. Delivery
We deliver to the locations shown on the Website or during checkout.
You are responsible for providing a complete and accurate:
- Recipient name;
- Delivery address;
- Email address; and
- Contact telephone number.
Delivery estimates are estimates unless we expressly agree to a guaranteed delivery date. Delays may occur because of couriers, weather, public holidays, rural delivery schedules or other circumstances.
Where Perfume House arranges delivery, we remain responsible for ensuring the order is delivered within the agreed time or, if no time was agreed, within a reasonable time as required by law.
16. Incorrect Delivery Information
Please check your delivery information carefully before submitting an order.
If you provide an incorrect or incomplete address:
- Contact us immediately.
- We will try to correct it before dispatch but cannot guarantee that this will be possible.
- You may be responsible for reasonable redelivery or address-correction costs where the error was not caused by us.
- We may require payment of those costs before resending a parcel returned to us.
This section does not apply where the delivery problem was caused by Perfume House or its delivery provider.
17. Authority to Leave
If you request or authorise a parcel to be left unattended, the courier may leave it in accordance with your instructions where permitted.
Any authority-to-leave instruction is subject to the courier’s conditions. We may require signature delivery for certain orders.
Nothing in this clause removes any responsibility Perfume House has under the Consumer Guarantees Act or other applicable law.
18. Lost, Delayed or Damaged Deliveries
If an order is delayed, damaged or appears to be lost, please contact us promptly so we can investigate.
Keep all packaging and provide reasonable information such as photographs, delivery notifications or courier details where available.
Where Perfume House arranged delivery, we will provide the remedy required under New Zealand law if the order is lost, damaged, delivered unreasonably late or not delivered.
We may need to complete a reasonable courier investigation before confirming that a parcel is lost.
19. Risk and Ownership
Ownership of a product passes to you once we have received full payment for it.
Risk will pass in accordance with applicable New Zealand law. Nothing in this clause removes our responsibility where Perfume House arranged delivery and the product is lost or damaged before it is properly delivered.
20. Returns, Refunds and Replacements
Returns, refunds, replacements and order cancellations are governed by our Refund, Return and Cancellation Policy.
That policy forms part of these Terms but does not limit your rights under the Consumer Guarantees Act or Fair Trading Act.
Change-of-mind returns are not automatically required under New Zealand law and are accepted only as set out in our published policy.
21. Authenticity
Perfume House is committed to supplying authentic products obtained through suppliers we reasonably consider reputable.
Manufacturer names, trademarks, bottle designs and product images remain the property of their respective owners. Their use on the Website is for product identification and description.
Unless expressly stated, Perfume House is an independent retailer and is not affiliated with, sponsored by or endorsed by any fragrance manufacturer or trademark owner.
22. Reviews and User Content
If you submit a review, photograph, comment or other content, you confirm that:
- It reflects your genuine experience or opinion.
- It is not false, misleading, defamatory, abusive or unlawful.
- It does not infringe another person’s intellectual-property or privacy rights.
- It does not contain malicious code, spam or unauthorised advertising.
You retain ownership of your content but grant Perfume House a non-exclusive, royalty-free licence to display and reproduce it for operating and promoting our business.
We may moderate or remove content that breaches these Terms. We will not suppress or manipulate genuine reviews merely because they are negative.
23. Acceptable Website Use
You must not:
- Use the Website for unlawful or fraudulent purposes.
- Attempt to gain unauthorised access to the Website or related systems.
- Introduce malware, viruses or harmful code.
- Scrape, copy or harvest Website content or customer information without permission.
- Interfere with Website security, availability or performance.
- Impersonate another person.
- Submit false account, payment or delivery information.
- Use automated systems to purchase products in a manner that unfairly prevents ordinary customers from purchasing them.

26. Third-Party Services and Links

We are not responsible for third-party content, availability, security or privacy practices that are outside our reasonable control. Accessing a third-party service may be subject to that provider’s own terms.
This section does not limit our responsibilities for providers acting on our behalf where New Zealand law makes us responsible.
27. Website Availability
We aim to keep the Website secure and available but cannot guarantee uninterrupted or error-free access.
We may temporarily restrict access to perform maintenance, install updates, respond to security issues or address circumstances beyond our reasonable control.
Where reasonably practical, we will try to minimise disruption.
28. Liability
To the fullest extent permitted by law, Perfume House is not responsible for loss caused solely by:
- Your misuse or improper storage of a product.
- Your failure to follow manufacturer instructions or safety warnings.
- Inaccurate information supplied by you.
- Unauthorised access resulting from your failure to protect account credentials.
- Third-party services outside our reasonable control.
We do not exclude liability for:
- Fraud or intentional misconduct;
- Liability that cannot legally be excluded;
- Breaches of the Consumer Guarantees Act or Fair Trading Act; or
- Any other mandatory obligation under New Zealand law.
29. Events Beyond Our Reasonable Control
We will not be responsible for a delay or failure caused by circumstances genuinely beyond our reasonable control, such as natural disasters, severe weather, transport disruption, government restrictions, widespread system failures or industrial action.
We will take reasonable steps to reduce the effect of the disruption and resume performance.
This section does not remove any right you may have to cancel, receive a refund or obtain another remedy under applicable law.
30. Privacy
We collect, use, store and disclose personal information as described in our Privacy Policy and in accordance with the Privacy Act 2020.
By using the Website, you acknowledge that personal information required to process your order may be shared with service providers such as payment processors and delivery companies.

31. Electronic Communications
You agree that order confirmations, invoices, notices and other transactional communications may be provided electronically using the contact details you supply.
Electronic communications and contracts may have legal effect under New Zealand’s Contract and Commercial Law Act 2017.
Marketing communications will be sent only where permitted by law. You may unsubscribe from marketing emails using the unsubscribe facility provided.
32. Changes to These Terms
We may update these Terms to reflect changes to our business, Website or legal obligations.
Updated Terms will be published on the Website with a revised “Last updated” date. Changes will apply from the published effective date and will not retrospectively alter an order already accepted unless required by law or agreed with you.
Your continued use of the Website after an update means that the revised Terms apply to your future use and purchases.
33. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or removed only to the extent necessary. The remaining provisions will continue to apply.
34. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean we have waived our right to enforce it later.
35. Governing Law
These Terms and any dispute relating to the Website or an order are governed by New Zealand law.
The parties submit to the non-exclusive jurisdiction of the New Zealand courts. You may also have the right to use the Disputes Tribunal or another applicable dispute-resolution process.
